Terms and Conditions for Online Art Sales

Please read the Terms and Conditions carefully before placing an order.

1. CUSTOMER SATISFACTION

We want you to purchase your original Canadian artwork knowing you will be fully satisfied.

At Houston North Gallery, we pride ourselves on providing the best customer experience by offering quality artwork and services with a no-argument guarantee. If for any reason you are not completely satisfied with your purchase, we will completely refund your order.

In the event that you wish to return your purchase, simply notify Houston North Gallery within ten (10) days of the receipt of the Work(s) of Art by e-mailing john@johnhouston.ca of any intended return. You may return any Work(s) of Art acquired for a complete refund, provided that:

The Work(s) of Art shall be returned in the same condition received and shipped within ten (10) days of the date of notification of such return.

You are responsible for shipping the artwork back to Houston North Gallery, and for the costs associated with that shipment (including insurance). Shipping and handling costs are non-refundable.

2. ABOUT HOUSTON NORTH GALLERY

We operate the website www.houston-north-gallery.ns.ca The Canadian corporation, N.N.E. Arts Limited, does business as Houston North Gallery, with our registered office at 5455 Inglis Street, Halifax, NS CANADA B3H 1J6. The gallery’s owner/director is John Houston.

3. INTELLECTUAL PROPERTY RIGHTS

All content included on this site, such as text, graphics, logos, button icons, images, and video and audio clips is the property of N.N.E. Arts Limited doing business as Houston North Gallery, or its content suppliers and protected by Canadian and international copyright laws. All software used on the website is the property of N.N.E. Arts Limited or the property of our software suppliers and is protected by international copyright laws. The content on this site may be used as an information and shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance, of the content on this site without the permission of Houston North Gallery is strictly prohibited.

Licence to use this website is granted limited to the following: You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions below. Without our prior written consent you must not republish material from this website (including republication on another website).

4. WORK OF ART COPYRIGHT

The purchase of any Work of Art does not transfer or assign or licence any copyright or other intellectual property rights to you. During the period in which the Work of Art is protected by copyright, the copyright remains with the artist (or any person to whom that right has been assigned). You are purchasing the Work of Art, but not the right to produce copies of the Work of Art (including photographs thereof ) for publication, or do any other act restricted by copyright. If such rights are sought, you should contact the copyright owner.

5. LIMITATION OF LIABILITY

The information on this website is provided free-of-charge, and whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date. We reserve the right to edit or remove any material posted upon our website.

6. PACKING, HANDLING, INSURANCE AND SHIPPING

We will be happy to provide a quote for the packing, handling, insurance and shipping any Work of Art. Simply identify the Work(s) of Art of interest, and e-mail their destination to john@johnhouston.ca, including any special requirements as to method of shipment. We pack the works in-house, meticulously, and have an excellent record of safe arrivals over the 40 years plus we’ve been in business.

7. DUTY AND TAXES

Canadian Customers: No duty costs apply, but Houston North Gallery will charge applicable GST/HST tax.

US Customers: FREE- Original Canadian artwork is entitled to enter the US duty-free. US customs may require a Tax ID or Social Security Number before releasing your shipment into the US. We cannot anticipate any brokerage fees and/or additional fees individual states may levy for web purchases after the fact.

Other Countries- Most nations allow the importation of original art works without duty. If unsure, check with your country’s duty policies.

8. PAYMENT

Houston North Gallery accepts major credit cards (VISA/MasterCard/AMEX) Interac e-Transfer, or Paypal for online payments. We also accept bank transfer, and will provide our banking information upon request. You will receive an emailed receipt to confirm we have received your order. You own the Artworks once we have received payment in full, including all applicable delivery charges.

9. AVAILABILITY

In the unlikely event that a Work of Art of is sold and has yet to be taken off the website, or is sold over the phone just prior to, or simultaneously to, our receipt of the online sale e-mail notification, the client to whom we have first confirmed the purchase shall have first rights to purchase and the other client will be fully refunded.

10. CURRENCY

All prices are in Canadian dollars unless otherwise specified. All prices are net of packing, handling, insurance, shipping, and before applicable GST/HST (for Canadian residents) is applied.

11. HOW WE USE YOUR PERSONAL INFORMATION

Houston North Gallery never discloses buyers’ information to third parties. We only use your personal information in accordance with our Privacy Policy. Please take the time to read this, as it includes important terms which apply to you.
